L1-b's Under "attack" by USCIS -   - posted: 02-10-2009

USCIS is sending detailed and cumbersome Requests for Information-- sometimes over a dozen pages long-- more akin to a "fishing expedition/investigation" (and sometimes calling the request an "Intent to Deny") for L1-b cases, among others. This is part of their fraud prevention program and also the result of a recent court case which gave the narrowest defnition of L1-b that we have seen--- Especially in regards to "specialized knowledge". Wherever possible, the better option is to utilize the L-1 A category if the applicant can reasonably fit into the Managerial/Executive category.
